These Terms of Service ("Terms") govern your access to and use of the website located at rtmpowerenergy.com (the "Site") and any related communications, quotes, proposals or services provided by RTM Power Energy LLC ("RTM Power Energy", "we", "us", "our"). By using the Site or submitting a quote request, you agree to these Terms.

1. Who We Are

RTM Power Energy LLC is a licensed and insured Florida solar contractor offering residential and commercial solar installation, battery storage, EV charger installation, electrical service upgrades, system removal & reinstall, and maintenance & monitoring services throughout the state of Florida.

2. Use of the Site

You may use this Site for lawful, personal and informational purposes. You agree not to:

Use the Site in any way that violates applicable law or regulation
Attempt to gain unauthorized access to the Site, our systems, or other users' data
Use automated scraping, bots or excessive crawling that may overload our infrastructure
Submit false, misleading or harmful information through any form
Reproduce, copy or republish content from this Site without our written permission

3. Quote Requests & Estimates

Estimates are non-binding

Any savings figures, payback periods, monthly-bill reductions, system sizes, pricing ranges or financing terms shown on this Site or in initial quotes are estimates only. Actual savings, system performance and pricing depend on many factors, including your roof condition, shading, energy usage, utility tariffs, permits, equipment availability, applicable incentives, your credit profile (for financing) and the final site assessment.

Binding agreements

A binding agreement between you and RTM Power Energy is created only when both parties sign a written installation agreement or service contract that defines scope, equipment, price, schedule and warranties. Information posted on this Site or in marketing materials is not a binding offer.

Quote validity

Quotes are valid for 30 days from issue unless otherwise stated. Pricing may change due to equipment cost, utility-program changes, permit-fee updates, or tariff changes.

4. Communication & Consent (TCPA)

Phone, Text & Email Consent By submitting our quote form, you expressly consent to be contacted by RTM Power Energy by phone, SMS text message and email at the contact details you provide — including through automated dialing systems and prerecorded messages — for purposes related to your solar quote and services. This consent is not required as a condition of any purchase. Message and data rates may apply. To opt out of texts reply STOP. To unsubscribe from marketing emails, use the link in any message.

5. Financing, Incentives & Tax Credits

If you choose to finance your installation, financing is provided by independent third-party lenders. RTM Power Energy is not a lender and does not guarantee approval, rates or terms. Federal solar tax credits, state rebates and utility incentives are administered by government agencies and utilities; eligibility, amounts and program rules can change at any time. We will share publicly available information on incentives but cannot provide tax, legal or financial advice — consult a qualified professional regarding your specific situation.

6. Installation Warranties

Equipment warranties (panels, inverters, batteries, chargers) are provided by the original manufacturer and governed by their specific warranty documents. RTM Power Energy provides a workmanship warranty as defined in your signed installation agreement. Warranty terms, durations and coverage are documented separately and supersede any general statements made on this Site.

7. Intellectual Property

All content on this Site — including logos, brand names, photos, text, graphics, code and design — is owned by RTM Power Energy LLC or licensed to us, and is protected by copyright, trademark and other intellectual-property laws. You may not reproduce, modify, distribute or create derivative works without our prior written permission.

8. Third-Party Links & Services

This Site may link to third-party sites or embed third-party services (e.g., Google Apps Script for form processing, financing partners, social media). We are not responsible for the content, privacy practices or terms of any third-party site or service. Your use of those is governed by their own terms.

9. Disclaimers

The Site and its content are provided "as is" without warranties of any kind, either express or implied, including merchantability, fitness for a particular purpose, non-infringement, or accuracy of content. We do not warrant that the Site will be uninterrupted, secure or error-free, or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, RTM Power Energy LLC and its officers, employees, contractors and affiliates shall not be liable for any indirect, incidental, consequential, special or punitive damages — including lost profits, lost savings, lost data or business interruption — arising from or related to your use of this Site, even if we have been advised of the possibility of such damages. Our total liability for any direct claim arising from this Site shall not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow these limitations; they apply to the fullest extent permitted in your jurisdiction.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

14. Severability & Entire Agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy and any signed installation agreement, constitute the entire agreement between you and RTM Power Energy regarding the use of the Site.
